YOU WANT TO AVOID THIS

The law gives you the freedom to make a Will that distributes your property how and to whom you wish. But if you die without a Will in Texas, the Texas intestacy statutes control.
The intestacy statutes are the Texas legislature’s best guess about how you would want your property distributed when you die.   Factors such as whether you are single or married, have children or not, and if you are married, whether the property is characterized as separate property or community property dictate who will receive your property. This can result in your property being distributed in a way you do not intend.

DO I NEED A LOT TO HAVE A WILL?

Estate planning is not just for wealthy people. Almost everyone has an estate. Your estate is comprised of everything you own, such as your real estate, vehicles, checking and savings account, retirement plans, life insurance policies, and personal possessions. Estate planning allows you to appoint trusted individuals to manage your affairs and make medical decisions for you if you become incapacitated, and ensure your property is distributed how and to whom you choose after you die.

TRUST SOUNDS FANCY. DO I NEED A TRUST?

A trust is a fiduciary relationship where a one party, called a trustee, hold assets on behalf of a beneficiary or beneficiaries. There are many different types of trusts: revocable trusts, irrevocable trusts, special needs trusts, support trusts. Trusts can come to life while you are living (intervivos trusts), or spring to life after you die (testamentary trusts). WHAT IS PROBATE?

Probate is the process of validating a Will, although the term is often used to refer to the entire administration of a decedent’s estate. The process starts when an executor files an application to probate the Will. If the probate judge determines that the document meets the legal requirements of a valid Will, the judge will enter an order admitting the Will to probate, and appoint an executor to gather the decedent’s assets, pay off any legally enforceable debt, and distribute the decedent’s assets as specified in the Will. Probate can also occur if someone dies without a Will. When someone dies without a Will, the probate court is often called upon to make an official determination regarding the identify of heirs. If the determination of heirship proceeding is filed within four years of the decedent’s death, then the court can also appoint an administrator to administer the estate.
